Thank you for visiting Anna Anderson Art. These Terms & Conditions apply to your use of this website and to any purchase you make through it.
Please read them carefully before placing an order. By placing an order through this website, you agree to these Terms & Conditions.

2. Artwork
I create and sell original paintings, prints and commissioned artwork.
Every original artwork is individually created and may contain small variations, marks or characteristics that are part of the handmade nature of the work.
I make every reasonable effort to ensure that photographs, colours, descriptions and dimensions shown on the website are accurate. However, colours may appear slightly different depending on your monitor, screen or device.
Unless specifically stated otherwise, frames are not included with original artwork or prints.
3. Prints
Prints are produced from my original artwork.
Print orders are fulfilled and shipped on my behalf by The Print Space, a professional art-printing and fulfilment service.
The Print Space may produce and dispatch your print directly to you, but your contract of sale remains with Anna Anderson Art.
Where a print is described as a limited edition, the total edition size will be stated in the product description. Limited-edition prints may be individually signed and/or numbered.
4. Prices and VAT
All prices shown on this website are in pounds sterling (£) and include VAT where applicable.
The price displayed to you is the price you will pay for the artwork, excluding any separately stated delivery charges.
Any applicable delivery charge will be clearly displayed before you complete your purchase.
I take reasonable care to ensure that all prices displayed on the website are correct and that the total price, including applicable taxes and mandatory charges, is made clear before you place your order. UK guidance requires consumer-facing prices to include applicable VAT and other mandatory charges. (GOV.UK)
I reserve the right to change prices at any time. A price change will not affect an order that I have already accepted.
5. Payment
Payment is processed securely through Wix Payments.
Payment is taken when you place your order through the website.
I do not have access to or store your full payment card details.
Your order will not normally be processed until payment has been successfully received.
6. Placing an Order
When you place an order, you are offering to purchase the selected artwork or product.
You will receive an order confirmation by email acknowledging that your order has been received.
Your order will be accepted when I confirm acceptance of the order or begin processing/fulfilling it.
If I am unable to fulfil an order, for example because an item is unexpectedly unavailable, I will contact you and provide a full refund for any payment already made.
You are responsible for ensuring that the information you provide when ordering, including your name, email address and delivery address, is accurate.
7. Delivery
Delivery options, estimated delivery times and delivery charges will be displayed during the ordering process.
For prints, your order may be produced and dispatched directly by The Print Space on behalf of Anna Anderson Art.
Delivery times are estimates and may occasionally be affected by circumstances outside my reasonable control, including courier delays, postal disruption, customs delays or adverse weather.
Unless a different delivery period has been specifically agreed with you, goods will normally be delivered within 30 days of the order being accepted.
If an order is significantly delayed, I will contact you and explain the available options.
8. International Orders
I may accept orders for delivery outside the United Kingdom.
If you order from outside the UK, your order may be subject to import duties, taxes, customs charges or other fees imposed by the destination country.
Unless explicitly stated otherwise at checkout, these charges are the responsibility of the customer.
Delivery times for international orders may also be affected by customs procedures in the destination country.
9. Your Right to Cancel an Online Order
If you are a consumer purchasing a standard, non-personalised item online, you normally have a legal right to cancel your order within 14 days of receiving the goods, without giving a reason.
If you wish to cancel, you must tell me within those 14 days.
After notifying me, you normally have a further 14 days to return the goods.
The returned item should be unused and in its original condition, with reasonable care taken to ensure it is safely packaged.
Where you exercise your statutory cancellation right, I will refund the purchase price and the cost of standard delivery originally paid.
If you chose a more expensive delivery option, I am only required to refund the cost of the standard delivery option.
I will normally issue the refund within 14 days of receiving the returned goods, or, where applicable, within 14 days of receiving evidence that you have returned them.
You may be responsible for the direct cost of returning the goods unless the item is faulty, damaged or incorrectly supplied.
These cancellation rights reflect the protections provided to consumers buying goods online under UK law. (GOV.UK)
10. Exceptions to the Right to Cancel
The statutory 14-day cancellation right does not apply to certain types of goods.
This includes goods that are:

made to your specifications;
-
clearly personalised; or
-
otherwise covered by an applicable legal exception.
This is particularly relevant to commissioned artwork created specifically for an individual customer.
Where an item is excluded from the statutory cancellation right, this will be explained to you before you place your order where required.
Your statutory rights relating to faulty, damaged or incorrectly supplied goods are not affected.
11. Faulty, Damaged or Incorrect Items
Nothing in these Terms & Conditions affects your legal rights if an item is faulty, damaged or not as described.
If your artwork or print arrives damaged, please contact me as soon as reasonably possible and provide photographs of:
-
the artwork;
-
the packaging;
-
any damage to the packaging; and
-
the delivery/shipping label.
Please keep the original packaging until the matter has been resolved.
If you receive the wrong item, or an item is faulty or damaged, I will work with you to arrange an appropriate remedy in accordance with your statutory rights.
12. Commissioned Artwork
I welcome enquiries for bespoke and commissioned artwork.
Before a commission begins, I will agree with you the important details, which may include:
-
the subject;
-
size;
-
medium;
-
style;
-
price;
-
payment arrangements;
-
expected completion date; and
-
delivery arrangements.
A deposit or full payment may be required before work begins.
Because commissioned artwork is created specifically for you, it may fall within the legal exception for personalised or made-to-order goods and therefore may not have the normal 14-day cancellation right.
I will make this clear when agreeing the commission with you.
Once work has commenced, changes to the agreed brief may result in additional charges or an amended completion date.
I reserve the right to decline a commission request.
13. Commission Payments
Unless otherwise agreed in writing, the payment arrangements for a commission will be confirmed before work begins.
Where a deposit is paid, the purpose and amount of the deposit will be explained at the time of booking.
Any cancellation or refund of a commission will be dealt with in accordance with the terms agreed for that particular commission and applicable UK consumer law.
14. Artistic Variation
Artwork is a creative and handmade product.
For commissioned artwork in particular, the finished piece may differ slightly from preliminary sketches, photographs or discussions.
Minor artistic differences do not constitute a fault where the finished artwork reasonably follows the agreed brief.
15. Copyright and Intellectual Property
All artwork displayed on this website, including original paintings, illustrations, photographs, designs, logos, written content and other creative material, remains the intellectual property of Anna Anderson Art unless otherwise stated.
Purchasing an original painting or print does not transfer copyright to the purchaser.
You may display artwork you have purchased for personal use, but you may not:
-
reproduce it commercially;
-
scan or copy it for reproduction;
-
create prints or other products from it;
-
sell reproductions;
-
use it commercially;
-
reproduce it on merchandise; or
-
otherwise exploit the artwork without my prior written permission.
Copyright in commissioned artwork also remains with Anna Anderson unless a separate written agreement states otherwise.
16. Photography of Commissions
I may photograph completed commissioned artwork for my portfolio, website, social media and promotional purposes.
If you would prefer your commissioned artwork not to be used in this way, please let me know before the commission is completed and I will respect that request.
17. Website Content
I make reasonable efforts to ensure that the information on this website is accurate and up to date.
However, I cannot guarantee that the website will always be available or completely free from errors or technical interruptions.
I reserve the right to update product descriptions, artwork availability, prices and other website content when necessary.
18. Events Outside My Reasonable Control
I will not be responsible for delays or failure to fulfil an order where this results from circumstances outside my reasonable control.
This may include, for example:

postal or courier disruption;
-
strikes;
-
severe weather;
-
natural disasters;
-
interruption to utilities or internet services;
-
technical failures;
-
customs delays;
-
government restrictions; or
-
other unforeseen circumstances.
Where reasonably possible, I will contact you and take appropriate steps to minimise the effect of the delay.
19. Personal Information
When you place an order or contact Anna Anderson Art, I may collect personal information necessary to process your order and communicate with you.
This may include your name, email address, billing information and delivery address.
Your personal information will be handled in accordance with my Privacy Policy.
20. Limitation of Liability
Nothing in these Terms & Conditions limits or excludes any liability that cannot legally be limited or excluded.
This includes your statutory rights as a consumer and liability for matters such as fraud or fraudulent misrepresentation.
Subject to this, Anna Anderson Art will not be responsible for indirect or consequential losses that arise outside the normal purpose of purchasing the artwork.
21. Complaints
I want you to be happy with your artwork and with your experience of buying from Anna Anderson Art.

22. Governing Law
These Terms & Conditions are governed by the laws of England and Wales.
If you are a consumer, you will also benefit from any mandatory consumer protection laws that apply to you in your country of residence.
